Welcome to Real Estate Concierge. By accessing or using our website, services, or any related platforms (collectively referred to as the “Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please refrain from using our Services.

1. Nature of Services

Real Estate Concierge operates as an independent real estate consultancy and promotional agency specializing in the promotion and marketing of residential, vacation, and investment properties in Costa Rica.

  • Advisory and Promotion: We provide impartial guidance and assistance in identifying properties that align with our clients’ preferences and investment goals.
  • No Development Responsibility: Real Estate Concierge does not act as a property developer and is not responsible for any aspect of the construction, pricing variations, timelines for delivery, or warranties associated with the properties promoted.
  • Third-Party Developers: All properties promoted by Real Estate Concierge are developed and managed by independent third-party developers. Any contractual relationship related to the purchase, development, or delivery of properties is strictly between the client and the developer.

2. Disclaimer of Liability

By using Real Estate Concierge’s services, you acknowledge and agree that:

  • No Construction Liability: Real Estate Concierge assumes no responsibility for the quality, structural integrity, or completion of the properties promoted.
  • No Pricing or Delivery Guarantees: Property prices, timelines for delivery, and other contractual conditions are subject to change at the sole discretion of the developers. REC is not liable for any fluctuations, delays, or modifications in these aspects.
  • No Warranty or Guarantee: Real Estate Concierge does not provide any explicit or implied warranties related to the properties, including but not limited to, habitability, compliance with local building regulations, or future appreciation in value.

3. Client Acknowledgment and Due Diligence

Clients acknowledge and agree that:

  • Independent Verification: It is the client’s responsibility to conduct their own due diligence regarding the legal standing, quality, and credibility of the developers before entering into any contractual agreement.
  • Legal and Financial Review: Real Estate Concierge strongly recommends that clients engage qualified legal and financial advisors to review contracts, assess legal documentation, and confirm compliance with Costa Rican laws.
  • Property and Title Verification: Clients are solely responsible for verifying the legitimacy of property titles and related documentation before purchase.

4. Limitation of Liability

To the fullest extent permitted by Costa Rican law:

  • No Indirect or Consequential Damages: Real Estate Concierge shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of its services or the purchase of any property.
  • No Developer Liability: Real Estate Concierge is not responsible for the actions, omissions, or breaches of contract by the developers, including construction defects, missed deadlines, or financial insolvency.
  • Force Majeure: Real Estate Concierge shall not be held liable for any failure or delay in performing its obligations due to circumstances beyond its control, including but not limited to, natural disasters, government actions, or unforeseen regulatory changes.

5. Third-Party Relationships

  • No Agency Relationship: Real Estate Concierge does not act as an agent or representative of any developer, contractor, or third party.
  • Referral and Promotion Only: Our services are limited to providing information, promoting available properties, and connecting clients with developers.

6. Intellectual Property

  • Ownership: All content, graphics, logos, and materials on Real Estate Concierge’s website and promotional materials are the intellectual property of Real Estate Concierge and may not be copied, reproduced, or distributed without express written consent.
  • Third-Party Content: Property images, descriptions, and promotional materials provided by developers remain their intellectual property.

7. Confidentiality and Data Protection

  • Privacy Compliance: Real Estate Concierge is committed to protecting your personal information in accordance with Costa Rican Law No. 8968 on the Protection of Individuals Regarding the Processing of Their Personal Data.
  • Data Usage: Client data collected through our platform is used solely for the purpose of providing services and will not be shared with third parties without consent, except where required by law.

8. Governing Law and Jurisdiction

  • Applicable Law: These Terms shall be governed by and construed in accordance with the laws of Costa Rica.
  • Dispute Resolution: Any dispute arising from or related to these Terms or the services provided by Real Estate Concierge shall be subject to the exclusive jurisdiction of the competent courts in San José, Costa Rica.

9. Modifications and Updates

Real Estate Concierge reserves the right to modify or update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
